Store Legal Terms and Disclaimer

Bolesa Net platform is the trade name of Bayan Al-Isal Information Technology Company, registered with the Saudi Ministry of Commerce under No. 024223 and licensed by the Communications and Information Technology Commission under No. 2023062050. It will be referred to in this agreement as Bolesa Net platform. As stated in the definition, Bolesa Net is an intermediary between the merchant and Bolesa partners from various shipping companies providing shipping services to merchants. Therefore, Bolesa Net platform disclaims any responsibility for any practices that violate the laws and regulations in force in the Kingdom of Saudi Arabia and the countries where Bolesa services are available. The merchant bears the consequences of violating these laws and regulations, including criminal, financial, moral, or legal damages. The merchant is fully responsible for the products and goods they provide and the contents of their shipments, as well as any resulting compensations and fines arising from violating the aforementioned points.

  1. The merchant acknowledges that it is a legally established commercial company subject to the laws of the Kingdom of Saudi Arabia, and that its store complies with trade and labor regulations in the Kingdom of Saudi Arabia. Bolisah platform disclaims any responsibility for merchants violating trade, retail, and e-commerce regulations in the Kingdom of Saudi Arabia.
  2. The merchant undertakes to obtain official licenses for certain specialized products and approvals from the Food and Drug Authority and the Standards and Metrology Authority. Bolisah platform disclaims any responsibility towards merchants who violate these requirements.
  3. The merchant is fully responsible for the accuracy of this information and any resulting damages or penalties in accordance with the trade and retail regulations in the Kingdom of Saudi Arabia and the requirements of the Food and Drug Authority and the Standards and Metrology Authority.
  4. According to the Parcel Transport Regulation issued by the Communications and Information Technology Commission, which is the authority regulating and licensing parcel transport service providers, shipping companies are prohibited from transporting the following materials and contents. Therefore, merchants are prohibited from shipping them through Bolisah and shall bear all consequences arising from violating this regulation and its restrictions.
  5. If the merchant fails to meet the obligations stated in the agreement and/or fails to accept the return shipments, the shipping company has the right to dispose of these shipments at its discretion without the need for any legal procedure or court order in this regard. Under this agreement, the merchant agrees to indemnify, defend, and hold the shipping company harmless from any liability, cost, loss, expense, or claim by any third party (including official authorities) arising out of or related to the disposal of such shipments.
  6. The customer undertakes to ensure that shipments handled by companies contracted with the Bolisah platform do not contain: (a) anything that cannot be transported safely or legally; (b) anything prohibited under any law or regulation; (c) bullion, currency, hazardous shipments, flammable materials, or narcotics, and shall comply at all times with the dangerous goods policy of companies contracted with the Bolisah platform; (d) bearer negotiable instruments such as bearer checks/drafts, bearer money orders, bearer bonds, bearer certificates, stamps, open tickets, unendorsed traveler’s checks, credit cards, or cards (except for gift cards). In case of violating any of the above, the customer agrees to indemnify Bolisah platform, its officers, directors, employees, and representatives from any harm, damages, costs, claims, or liabilities, including reasonable attorney’s fees, incurred by any of the companies contracted with the Bolisah platform arising from or related to the customer’s breach of obligations stated herein.
  7. The customer shall declare to the Bolisah platform the contents and actual value of each shipment before these shipments are received by companies contracted with the platform and shall bear sole responsibility for any false declaration of the shipment. The customer shall also provide Bolisah with all necessary documents and fulfill all requirements and procedures to expedite the clearance of shipments as may be requested by the shipping company.
  8. The customer confirms that all data and information provided by the customer or its agents regarding the shipments and the Cash on Delivery (COD) amount to be collected by Bolisah under this agreement will be accurate. The customer shall indemnify the beneficiaries of the Bolisah platform for any damages, costs, claims, liabilities, or expenses, including reasonable attorney’s fees, incurred by Bolisah arising from or related to the customer’s or its agents’ breach of obligations under this agreement or any illegal use of the COD amount collected and transferred.
  9. Any legal fines, storage fees, or other expenses imposed as a result of customs or government authority procedures or the customer’s failure to provide proper documentation and/or correct declaration of the contents and actual value of the shipments and/or obtain the required license or permit for the shipments shall be borne by the customer.

What is the Shipping Waybill Issuance Service

The shipping service from Boleasa enables customers to benefit from the available shipping companies at discounted rates for shipping waybills. This is only by registering and subscribing to the platform. There are no contracts with shipping companies that require the customer's signature, but the customer must subscribe to the platform, recharge the e-wallet, and accept the terms and conditions outlined on the platform before being enabled to issue shipping waybills.

Shipping with Boleasa

The shipping service from Boleasa enables customers to benefit from the available shipping companies at discounted rates for shipping waybills. This is only by registering and subscribing to the platform. There are no contracts with shipping companies that require the customer's signature, but the customer must subscribe to the platform, recharge the e-wallet, and accept the terms and conditions outlined on the platform before being enabled to issue shipping waybills.

Cash on Delivery

In case the customer wishes to withdraw the Cash on Delivery (COD) funds from their wallet, they must select the shipping waybills whose status has been changed to 'Delivered', fill in the bank account details and bank address, and submit a withdrawal request. The amounts due to the customer will not be transferred until the amount is collected from the shipping company or within five business days, whichever comes first, for the shipments made through that company. These amounts will be transferred after receiving the request, reviewing it by the accounting department, and confirming it. Once the COD amounts are transferred, a proof of transfer will be sent to the email address registered on the Boleasa platform.

Shipping Fees and Additional Weights

Shipping fees are automatically calculated by the system based on the price shown, inclusive of VAT. The shipping rate displayed applies to domestic shipping within the Kingdom of Saudi Arabia, and the shipment will be delivered to the recipient either at their location or at the shipping company branch, depending on the coverage area of the selected shipping company by the customer (the sender). The weight of the shipment according to the displayed rate on the Boleasa platform is up to ten kilograms (volumetric or actual). If the shipped goods exceed ten kilograms, an additional fee of three SAR per extra kilogram will be charged. The volumetric weight is calculated by multiplying the shipment carton dimensions in centimeters and dividing the result by 4000. For example, if the carton dimensions are 20 cm in height, 30 cm in length, and 25 cm in width, the result is 15000, which when divided by 4000 gives a volumetric weight of 4 kilograms.

How to Ship Products

The products shipped by the customer must be packed inside the shipping company’s bags or cardboard boxes with at least three layers to protect the shipment from damage. Products that do not meet these specifications will not be accepted. The waybill must be printed from the system after issuance and attached to the shipment.

Refund of Waybill Value

The customer has the right to request a refund or cancel the shipping waybill after issuance within 24 hours from the issuance date. If the customer does not request cancellation, the waybill value will be charged. If the waybill is not used within seven days, it will be automatically canceled, and the waybill amount will not be refunded.

Modifying Shipping Waybills

The customer has the right to modify the recipient's phone number or address after the waybill is issued, and additional fees will apply according to the shipping company’s policy for waybill modifications. Cash on Delivery amounts cannot be modified after the shipping waybills are issued.

Returned Shipments

If the recipient does not collect the shipment, the shipping company will return the shipment to the branch or to the sender’s location, and a new waybill fee will be charged to the customer as a return shipment fee.

Shipment Contents

The Boleasa platform is not responsible for the contents of the shipment, and the customer must disclose the contents to the shipping company representative if requested. The customer bears all legal liability regarding the products they ship. In case of damage, loss, or compensation related to the shipments, whether caused by the merchant to the shipping company or by the shipping company to the merchant’s shipments, the policies of the shipping company handling the shipment will apply, including any financial or moral compensations or investigations related to the incident. In such cases: (1) the Boleasa platform is not a party to such disputes, and (2) the Boleasa platform is not responsible for any damages whatsoever, and the customer has no right to claim any compensation from the Boleasa platform of any kind.

Delayed Shipments

In case of shipment delays with the shipping companies, the Boleasa platform will follow up with the shipping companies to resolve the issue at the earliest opportunity.

In Case of Damage, Loss, or Compensation

If any damage occurs caused by the merchant to the shipping company or by the shipping company to the merchant’s shipments, the policies of the shipping company handling the shipment will apply, including any financial or moral compensations or investigations related to the incident. In such cases: (1) the Boleasa platform is not a party to such disputes, and (2) the Boleasa platform is not responsible for any damages whatsoever, and the customer has no right to claim any compensation from the Boleasa platform of any kind.

Customer Policy for E-Wallet Recharge Refund and Its Duration

The customer has the right to request a refund of the e-wallet recharge amount within a maximum of 30 days from the recharge date, and the amount will be refunded within 10 business days from the refund request. In case the customer subscribes to any Boleasa platform offers, the additional amount will not be refunded.
